General Terms and Conditions

These General Terms and Conditions (“General Terms and Conditions for Consumers”) apply to the use of the gift voucher website (“Website”) and when you purchase a Vienna Marriott Hotel gift voucher (“Gift Voucher”). SK Chase acts as an agent for the Vienna Marriott Hotel regarding the purchase of vouchers and is a company registered in Scotland (No. SC253912) with its registered office at 31 Palmerston Place, Edinburgh, EH12 5AP. The Vienna Marriott Hotel website has its own terms and conditions that apply to the use of this website. Before placing an order on the website, you will be asked to agree to these General Terms and Conditions for Consumers and to be legally bound by them. Please read them carefully before placing your order. If you do not accept these terms and conditions, you cannot order products through this website. We, the Vienna Marriott Hotel, reserve the right to change these General Terms and Conditions for Consumers from time to time. It is your responsibility to review these General Terms and Conditions for Consumers before each purchase to be informed of any changes. If we need to change the General Terms and Conditions for Consumers that apply to your order, we will contact you to inform you of these changes in a timely manner and to let you know how you can cancel the order if you do not agree with the changes. Upon receipt of your cancellation notice, the Vienna Marriott Hotel will arrange a full refund of the amount you paid. If you have already received the gift voucher you canceled, you must destroy it. As a consumer, we are legally obliged to supply products that comply with our contract with you. You, as a consumer, have statutory rights in relation to products that are faulty or not as described. These statutory rights are not affected by your right to cancel or by the exercise of other provisions of these General Terms and Conditions. The Consumer Protection Act applies to purchases by end consumers.

1. Purchase

1.1 The website offers gift vouchers for sale.

1.2 There is no contract for the sale of a gift voucher between you and the Vienna Marriott Hotel until payment has been received in the Vienna Marriott Hotel’s account and no payment claim has been made. The Vienna Marriott Hotel will invalidate vouchers that have not been paid for in the system, and these vouchers cannot be redeemed at the hotel.

1.3 You must check the details in the confirmation as soon as possible and you should print and keep a copy.

1.4 When purchasing a voucher through the website, payment is made by credit or debit card. You can pay with the following cards: Mastercard, Visa, Delta, American Express, Switch, or Solo. You can also purchase vouchers at the Vienna Marriott Hotel.

1.5 You agree that all information you provide for the purpose of ordering gift vouchers is correct, that the credit or debit card you use is your own, and that there are sufficient funds to cover the cost of the ordered gift voucher.

1.6 To protect your data during the order process, the website uses a software package known as Secured Sockets Layer (SSL).

4. If the value of the consumption is lower than the voucher value, no cash will be given.
5. Children’s policy: Children aged 0-5 years are free of charge, children aged 6-11 years pay half price, and from 12 years onwards, the full price is charged.
6. An invoice with tax details can only be issued at the time of voucher redemption (UstG).
7. The voucher only becomes valid after payment by credit card (Visa, Mastercard, American Express, Diners Club, JCB).
8. The voucher is redeemable for one year from the date of issue.
9. The place of jurisdiction is Vienna.
10. The hotel accepts no liability for delays due to postal delivery. Please allow at least 10 working days for delivery.
11. Otherwise, the General Terms and Conditions of the Austrian Hotel Contract apply.
12. Customers who are consumers within the meaning of the Consumer Protection Act can withdraw from a contract concluded at a distance (or a declaration of contract made at a distance) within a period of fourteen days. The withdrawal period begins on the day the contract is concluded, with Saturdays not counting as working days. It is sufficient if the withdrawal declaration is sent within the period without giving reasons. However, the right of withdrawal does not exist if the service has already begun within the withdrawal period by agreement.
13. All vouchers are value vouchers and can be used for all services of the Vienna Marriott Hotel.
14. Each gift voucher sold is subject to the terms of use that can be viewed on the website next to each of the gift vouchers, and these apply in addition to the conditions in these General Terms and Conditions for Consumers. All prices on the website include VAT (if applicable).
15. The following shipping options are available to customers:

Email - Once the transaction is complete, an automatic email with a link to the gift voucher will be sent. This can be sent either to the buyer or the recipient. This is a system-generated email and may therefore end up in the recipient’s spam folder. Please also ensure that the email address entered is correct. If email delivery fails, we will try to contact you to inform you that we have received a message that the email was not delivered. We will then try to obtain another email address. If you have difficulty opening the link for your gift voucher, please follow the instructions below.

3. Cancellations

3.1 Please remember that in addition to the conditions contained in these General Terms and Conditions for Consumers, the conditions applicable to each gift voucher are individual to each gift voucher and can be viewed on the website in connection with the individual gift vouchers. The following provisions in this section 3 apply to all gift vouchers, except: (a) the gift voucher is valid for a specific date or period of service;

 3.2 All specific agreements regarding booking dates and times must be made directly with the Vienna Marriott Hotel, and you should reconfirm all agreements made with the Vienna Marriott Hotel before the event to avoid disappointment. The Vienna Marriott Hotel will make all reasonable efforts to accommodate your request but cannot guarantee a specific date or time.

 3.3 Nothing in the General Terms and Conditions for Consumers or in the additional conditions applicable to gift vouchers changes or affects your statutory rights (including your right to a refund for faulty or misdescribed gift vouchers).

 3.5 According to the provisions of the Consumer Protection Contracts 2013, the right of withdrawal, and the provisions for additional charges, you have the right to cancel your order with the Vienna Marriott Hotel from the date SK Chase sends you the shipping information (this is the point at which the contract with the Vienna Marriott Hotel is concluded) and up to either of the following points: (a) 14 days from the day after you receive your gift voucher (the “cancellation period” if your contract concerns a gift voucher) or (b) 14 days from the day after you receive the last ordered gift voucher (the “cancellation period” if it concerns multiple gift vouchers delivered on different days).

3.6 If you wish to cancel your order either before or after receiving the gift voucher, you must inform the Vienna Marriott Hotel within the cancellation period that you have decided to withdraw from the contract. The easiest way to do this is to contact the Vienna Marriott Hotel as per section 4.1. If you choose to cancel by email, your cancellation will be effective from the day you send the email to the Vienna Marriott Hotel.

3.7 If you cancel the contract during the cancellation period, the Vienna Marriott Hotel will refund the amount you paid for the gift voucher(s) within 14 days from the day the Vienna Marriott Hotel receives your cancellation notice.

3.8 If you have already received the gift voucher you canceled, you must destroy it. If the Vienna Marriott Hotel determines after receiving your cancellation notice that the gift voucher has already been used, you are not entitled to a refund.

5. Liability

5.1 This section applies only to the extent permitted by law. To avoid doubt: the Vienna Marriott Hotel does not exclude liability for (a) personal injury (including illness and death) if this is due to negligence or willful misconduct on the part of the Vienna Marriott Hotel or the employees, agents, or subcontractors of the Vienna Marriott Hotel or due to (b) fraud or fraudulent misrepresentation.

 5.2 If the Vienna Marriott Hotel breaches the contract with you, the Vienna Marriott Hotel is only responsible for reimbursing the cost of the gift voucher. The Vienna Marriott Hotel is not obliged to compensate you for any other compensation or losses you suffer as a result of the breach of contract by the Vienna Marriott Hotel.

5.3 The Vienna Marriott Hotel undertakes to provide the services for which the gift voucher was purchased in accordance with the description on the website and the Vienna Marriott Hotel website (if applicable) at all times with reasonable skill and care, provided these are still offered at the hotel. As each voucher is a value voucher, all vouchers, regardless of the purpose described on the voucher, can be used for all services offered at the Vienna Marriott Hotel. The Vienna Marriott Hotel makes no other warranties and gives no other assurances.

The website is protected by copyrights and other intellectual property rights. We or SK Chase are the owners or licensees of all copyrights, trademarks, design rights, patents, and other intellectual property rights on this website and the material published on it. You may access the website and download parts of it for private viewing purposes on a PC, but for no other purpose. NONE OF THE CONTENT MAY BE DOWNLOADED, USED, DISTRIBUTED, TRANSMITTED, STORED, SOLD, OR DISTRIBUTED WITHOUT OUR PRIOR WRITTEN CONSENT.

7. Disclaimer

 By accessing and using the website or any of the information contained therein, you acknowledge that, although reasonable efforts have been made to ensure that all information contained on the website is correct, accurate, and up-to-date, neither SK Chase nor Vienna Marriott Hotel accepts any liability, makes any representations, or undertakes any obligations that the material on the website is free from harmful materials, viruses, worms, Trojan horses, and/or other codes with contaminating or destructive properties. (It is your responsibility to take protective measures, such as virus checks).

8. Governing Law and Jurisdiction

The website and the General Terms and Conditions for Consumers are governed by the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish courts in all matters relating to the use of the website and these General Terms and Conditions for Consumers. If any provision of these General Terms and Conditions for Consumers is found to be invalid by a competent court, you agree that the other provisions of these General Terms and Conditions for Consumers shall remain in full force and effect as far as possible. If you access the website from outside the United Kingdom, you are responsible for complying with local laws regarding access.
